What does Assembly Bill (AB) 794 require?
AB 794 requires fleet purchasers of new drayage and short-haul trucks participating in incentive programs funded or administered by the California Air Resources Board (CARB) to attest to labor law compliance. Fleet purchasers receiving incentives are required to sign agreements that condition the incentive on compliance with AB 794.
When did the requirements of AB 794 take effect?
The requirements took effect July 2022.
Does AB 794 apply to me?
AB 794 applies to fleets that receive CARB incentive funding to purchase or lease a new drayage or short-haul truck.
I plan to apply for an incentive for one vehicle only. Does AB 794 apply to me?
Yes, the AB 794 fleet purchaser requirements apply to you. The California Code of Regulations defines a fleet as one or more vehicles, owned by a person, business, or government agency traveling in California and subject to this regulation. (Cal. Code Regs., tit. 13, § 2025, subd. (d)(28).)
Attestations
What is an attestation?
An attestation is a formal declaration that affirms the truth or accuracy of a statement. AB 794 requires fleet purchasers to attest under penalty of perjury that they do not have an applicable law violation at the time of applying for the incentive, are not on the list maintained by the Division of Labor Standards Enforcement, and will maintain control over the manner and means for performance or any individual using or driving the vehicle. It is a violation of State law to submit false or misleading information.
Who is required to submit an AB 794 attestation?
Fleet purchasers participating in an incentive program funded or administered by CARB for the purchase of new drayage and short-haul trucks must submit an AB 794 attestation.

How often do I need to submit an attestation?
You must submit an attestation when you apply for an incentive and then renew your attestation on a yearly basis for the term of your incentive agreement.
Rental and Leasing Entities
What if I am a rental or leasing entity applying for incentives?
AB 2737 excludes rental or leasing entities from AB 794 fleet purchaser requirements. However, for leases greater than one year, you are required to notify the lessee that they must comply with AB 794 fleet purchaser requirements.
What if I am leasing a vehicle that was purchased with incentive funding?
If the lease agreement is greater than one year, AB 2737 requires the lessees to comply with the AB 794 fleet purchaser requirements. Lessors are required to notify lessees of the AB 794 fleet purchaser requirements.
Complaints
Do I need to provide my name and contact information?
You are encouraged to provide your contact information when submitting a complaint. This will allow CARB staff to contact you if there are any questions about the complaint. However, you can submit the complaint anonymously.
What should I do if I know a fleet is receiving incentive funding and they are not in compliance with the requirements of AB 794?

What information do I need to submit for an AB 794 complaint?
Please submit company information, your contact information, and the details of your complaint. If possible, include supporting documents like photos, contracts, pay stubs, or emails. Required fields are marked with a red asterisk.
What happens after I submit a complaint?
You will receive confirmation after you submit a complaint. CARB staff will review the complaint to determine if further investigation is necessary.
