LBCT LLC Settles Cargo Handling Equipment Violations for $35,200
In June 2020, the California Air Resources Board (CARB) settled a case for $35,200 with LBCT LLC (LBCT) located in Long Beach, California. The penalty was for violations of the Cargo Handling Equipment (CHE) Regulation. CARB staff discovered the violations during a routine inspection of CHE at the LBCT Terminal in the Port of Long Beach. An investigation by CARB showed that LBCT failed to perform annual opacity tests on 128 pieces of CHE as required by the CHE Regulation in 2018 and 2019. The penalty paid in this case was $275 per violation for 128 pieces of CHE. To settle the case, LBCT agreed to pay the $35,200 penalty and to comply with CARB’s CHE Regulation. Under the terms of the Settlement Agreement LBCT agreed to fund a Supplemental Environmental Project (SEP), the “Installation of Air Filtration Systems in Schools Phase 2.” To this end, LBCT paid $17,600 to the South Coast Air Quality Management District to administer the SEP, and $17,600 to CARB’s Air Pollution Control Fund.
