Tapia Brothers Enterprises, dba Tapia Brothers Co., Settles For $5,000
In March 2021, the California Air Resources Board (CARB) settled a case with Tapia Brothers Co., located in Maywood, California. CARB’s audit documented five violations of the TRU Air Toxic Control Measure (ATCM) regulation by Tapia Brothers Co. for operating Transportation Refrigeration Units (TRUs) with engines not in model year compliance.
Tapia Brothers Co. entered into a Settlement Agreement with CARB and agreed to pay $1,000 per noncompliant vehicle for a total penalty amount of $5,000. Terms of the settlement include a requirement for Tapia Brothers Co. to provide a compliance plan within 30 days for one remaining noncompliant TRU, which the company has provided to CARB. Tapia Brothers Co. was cooperative during the investigation, and the fleet has sold or updated all of their TRUs in violation with approved Verified Diesel Emission Control Systems (VDECS) and is now compliant with the TRU ATCM regulations.
