The TJX Companies Inc. Settles For $193,507
In November 2020, the California Air Resources Board (CARB) reached a settlement agreement with The TJX Companies Inc. (TJX), of Framingham, Massachusetts, for $193,507. TJX sold, supplied, and offered for sale in California finished goods that contained medium density fiberboard or thin medium density fiberboard that contained formaldehyde emissions above the limits set forth in the Airborne Toxic Control Measure to Reduce Formaldehyde Emissions from Composite Wood Products (ATCM). The ATCM has been in effect since January 1, 2009. In addition, TJX was found to be in violation of not taking reasonable and prudent precautions because they imported and sold finished goods without written documentation from their suppliers stating the products comply with CARB’s emission standards. The noncompliant finished goods sold by TJX include various home décor and home furnishing items. TJX has since stopped the sale of the noncompliant finished goods and has implemented measures to ensure future compliance to the ATCM, including vendor education, improved product inspections, and product testing.
