Wayfair LLC Settles For $17,600
In December 2022, the California Air Resources Board (CARB) reached a settlement with Wayfair LLC (Wayfair), with its principal location in Boston, Massachusetts for the company’s violations of CARB’s air quality regulations.
An investigation conducted by CARB staff showed that Wayfair violated the Regulation for Limiting Ozone Emissions from Indoor Air Cleaning Devices (Cal. Code Regs., tit. 17, § 94800 et seq.) because they sold, supplied, offered for sale, and introduced into commerce in California indoor air cleaning devices that were not certified by CARB. Indoor air cleaning devices are subject to an ozone emission concentration limit of 0.050 parts per million (ppm) and are required to be certified prior to sale in California. Additionally, Wayfair failed to include a statement excluding sales to California on webpages advertising uncertified indoor air cleaners.
The $17,600 will be deposited into CARB’s Air Pollution Control Fund, which provides funding for projects and research to improve California's air quality. To come into compliance, Wayfair implemented measures to confirm the certification status of the indoor air cleaning devices offered for sale by Wayfair. Wayfair included a statement excluding sales to California on webpages advertising uncertified indoor air cleaning devices and stopped sales of all uncertified devices in California. Wayfair fully cooperated with CARB toward resolution in this matter.
