CARB has been tasked by the legislature with development of annual greenhouse gas (GHG) emission standards that in part determine fuel cell system eligibility for the California Public Utilities Commission's (CPUC) Net Energy Metering (NEM) program for fuel cells. CPUC's fuel cell NEM provides monetary incentives to eligible fuel cell customer-generators that use non-renewable fuels and meet GHG emissions standards.
The fuel cell NEM program was originally established under Public Utilities Code section 2827.10. It provided eligible customer-generators with a bill credit for electricity generated and exported from a fuel cell system through a NEM tariff, and exempts fuel cell customer-generators from various utility standby, demand, and interconnection costs.
Assembly Bill 1637 (Low, Statutes of 2016) amended and extended the existing fuel cell NEM program. As amended, an eligible customer-generator is defined as a fuel cell sited on the customer’s side of the meter, sized to meet onsite load, and is no more than five megawatts in rated capacity. Eligible fuel cell systems also must meet CARB’s criteria pollutant emission standards adopted for the Distributed Generation Certification Program in addition to the annual GHG emissions standards.
