The California Air Resources Board (CARB) implements the Low Carbon Fuel Standard (LCFS) regulation, which appears at sections 95480 to 95503 of title 17, California Code of Regulations. Section 95490 of the LCFS incorporates the "Carbon Capture and Sequestration [CCS] Protocol under the Low Carbon Fuel Standard" ["the CCS Protocol"] dated August 8, 2018. The CCS Protocol establishes requirements for safe and permanent carbon dioxide (CO2) sequestration that CCS project must meet to generate LCFS credits. A CCS Project Operator must apply for Sequestration Site Certification pursuant to subsection C.1.1.2(b) of the CCS Protocol and CCS Project Certification pursuant to subsection C.1.1.2(d) of the CCS Protocol, which are collectively called Permanence Certification.
Pursuant to subsection C.1.1(b) of the CCS Protocol under the LCFS regulation, CARB posts an initial determination and a redacted version of the Permanence Certification application package for public comment for 15 calendar days. CARB must address comments received during the public comment period if considered valid. After valid comments have been addressed, CARB will issue a Permanence Certification for the project by executive order (i.e., only comments pertaining to how the project/application meets the requirements of CARB's CCS Protocol).

Instructions for Submitting a Comment
1. View the initial determination and application package by selecting the Application Number (i.e., "P0001").
2. Select "Submit Comments" for the specific application. In the comment subject line, please include the specific application number. For example, "Comments for application no. P0001".
